This template Affidavit of Service of Process may be used in New Jersey Superior Court pursuant to N.J. Ct. R. 4:4-7. It includes practical guidance, drafting notes, and optional clauses. Initial complaints and summons need to be served upon your opposing party pursuant to N.J. Ct. R. 4:4-3. After service of process, you must provide the court with proof of service of process within the same amount in which the party that you served has to respond to your complaint. N.J. Ct. R. 4:4-7. Service can be made by the sheriff of the county in which the party resides, or by a person specially appointed by the court for that purpose, or by plaintiff's attorney or the attorney's agent, or by any other competent adult not having a direct interest in the litigation. N.J. Ct. R. 4:4-3. The Affidavit of Service of Process must state the name of the person served and the place, mode and date of service. N.J. Ct. R. 4:4-7. If you are using a sheriff or a process server, they will provide you with a signed Affidavit of Service of Process. However, you will need this template if service is not made through the sheriff or a process server. Note that failure to file the Affidavit of Service of Process does not effect the validity of the service.
